Terms of Service

These Terms apply when you install, access, or use Franko Reviews, including the embedded Shopify admin app, theme app extension, review request emails, hosted review collection pages, widgets, and related services. In these Terms, "Franko," "we," "us," and "our" mean Franko AI. "Merchant," "you," and "your" mean the store owner or business using Franko Reviews.

Franko Reviews helps Shopify merchants request, collect, moderate, and display product reviews. The app may send post-purchase review request emails, host conversational review collection pages, generate review drafts from a customer's own responses, store submitted reviews and photos, and display approved reviews through storefront widgets.

You are responsible for:

• Using Franko Reviews only for stores and customer relationships you are authorized to manage.
• Complying with applicable consumer protection, privacy, email, anti-spam, advertising, and review laws.
• Making sure your store privacy policy tells customers how reviews and review request emails work.
• Not using Franko Reviews to create, buy, publish, or solicit fake or misleading reviews.
• Not offering incentives conditioned on customers leaving a positive or negative review.
• Moderating reviews fairly and not suppressing reviews in a deceptive or unlawful way.
• Keeping your Shopify account, app credentials, and staff permissions secure.

Customers own their original feedback. You are responsible for your use of reviews on your storefront and marketing channels. By using Franko Reviews, you authorize us to process review content, ratings, photos, and related metadata so we can provide the service.

Franko may help convert a customer's conversation into a review draft, but the draft should be based on the customer's own words and experience. You must not use Franko to publish reviews that materially misrepresent a customer's experience.

Franko Reviews may use AI systems to ask review questions, summarize customer feedback, suggest review drafts, classify product context, or assist with moderation. AI output can be imperfect. You are responsible for reviewing content before publishing it and for deciding whether any generated or assisted text is accurate, lawful, and appropriate.

If you enable review request emails, you authorize Franko Reviews to send transactional review requests to customers after eligible orders are fulfilled. You are responsible for confirming that these messages are lawful for your store, products, customers, and regions. Review request emails must include required unsubscribe and identity information where applicable.

Franko Reviews is designed to work with Shopify. Your use of Shopify remains governed by Shopify's own terms and policies. Franko is not responsible for Shopify outages, API changes, theme conflicts, merchant theme customizations, or third-party services outside our control.

If Franko Reviews offers paid plans, billing terms will be shown in Shopify or in the app before you approve a charge. You are responsible for charges you approve. Unless required by law or expressly stated otherwise, fees are non-refundable after the applicable billing period begins.

You must not use Franko Reviews to:

• Send spam or unlawful messages.
• Collect reviews for products or orders that do not exist.
• Publish fake, deceptive, harassing, defamatory, or infringing content.
• Upload malware or attempt to disrupt Franko, Shopify, or other merchants.
• Reverse engineer the service except where applicable law permits it.
• Access customer data except as needed for legitimate store operations.

You may stop using Franko Reviews by uninstalling the app from Shopify. We may suspend or terminate access if you violate these Terms, create risk for customers, misuse personal data, fail to pay approved fees, or use the service unlawfully. On uninstall, we process deletion and retention as described in our Privacy Policy.

Franko Reviews is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

To the fullest extent allowed by law, Franko will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Our total liability for claims relating to the service will not exceed the amounts you paid to Franko Reviews in the three months before the event giving rise to the claim, or USD $100 if you have not paid us.

These Terms are governed by the laws of Australia. You and Franko agree that any dispute arising out of or relating to these Terms or Franko Reviews will be subject to the exclusive jurisdiction of the courts of Australia, except where applicable law requires another forum.

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify merchants, such as by updating the in-app notice or changing the "Last updated" date. Continued use after an update means you accept the updated Terms.
